TERMS & CONDITIONS

Welcome to PINCH! These Terms and Conditions ("Agreement") govern your use of the services provided by PINCH, including our website and platform ("PINCH Platform"). By accessing or using the PINCH Platform, you agree to comply with and be bound by these terms. Please read them carefully before proceeding.

1. SERVICE DESCRIPTION

PINCH provides a platform that connects independent cleaning professionals ("Cleaners") with job opportunities in multifamily and commercial cleaning. By joining PINCH, Cleaners gain access to exclusive apartment community leads, back-office support, and training resources, while PINCH handles operational tasks such as insurance, invoicing, and payment processing.

Key Services Provided:

  • Access to Contract Opportunities: Cleaners receive exclusive leads for apartment cleaning contracts, with priority access for Quick Pay and ELITE members.

​

  • Sales and Marketing Support: PINCH’s national sales team secures large cleaning contracts, helping cleaners access corporate opportunities.

​

  • Administrative & Back-Office Support: PINCH manages invoicing, payment processing, vendor compliance, and other operational functions.

​

  • Training and Certification: Cleaners can access training courses on pricing, cleaning techniques, and sales strategies.

​

  • Business Growth Tools: PINCH provides tools like proposal templates, client management systems, and invoicing automation.

​

  • Faster Payments: Cleaners can access faster payouts through Quick Pay, reducing the wait time typically associated with multifamily cleaning.

Geographic Scope: PINCH operates nationwide and is available to cleaners in all U.S. states. Cleaners can sign up, receive training, and begin working on their own contracts and/or bidding on opportunities within their region.

2. USER RESPONSIBILITIES

By using the PINCH Platform, Cleaners agree to the following responsibilities:

  • Accurate Business Information: Cleaners must provide accurate, truthful information regarding their business, including background checks and work history.

​

  • Prohibited Activities:

​

  • Misuse of Leads: Cleaners may not solicit or poach clients obtained through PINCH.

​

  • Underbidding: Offering unrealistically low bids to win contracts and later raising the price is prohibited.

​

  • Failure to Adhere to Safety Standards: Cleaners must follow all OSHA safety standards and use appropriate cleaning supplies and PPE.

​

  • Unprofessional Behavior: Harassment, discrimination, and inappropriate conduct are prohibited.

​

  • Tampering with Payments: Cleaners are prohibited from manipulating invoices or engaging in any fraudulent payment practices.

​

  • Failure to Meet Requirements: Cleaners must comply with insurance and vendor policies for each job.

Consequences for Violations:

​

  • First Violation:  Warning and review.

​

  • Second Violation: Temporary suspension.

​

  • Repeated Violations: Permanent removal from the platform.

​​

3. PAYMENTS AND FEES

PINCH operates on a membership model with three available tiers:

​

  • MAX Membership ($10/month): Access to 5 apartment community leads per month, business tools, and basic training resources.

​

  • ELITE Membership ($25/month): Priority access to job opportunities, 10 apartment community leads per month, and higher priority for assigned jobs.  Payment within 22 days of job completion.

​

  • Quick Pay Membership ($50/month): Faster payouts (within 5 days), business coaching, and first-priority access to jobs. Includes a $4.95 bank fee per transaction.​

Revenue Split: PINCH retains 19% of each job’s revenue to cover operational costs. Cleaners receive 81% of the job revenue. Cleaners should factor this into their pricing when submitting proposals.

Cancellation and Refund Policy:

​

  • Cancellation: Cleaners may cancel their membership at any time via the platform. Cancellations take effect immediately, and no partial refunds are provided.

​

  • Refunds: Subscription fees are non-refundable unless there is a billing error or system malfunction. ELITE and Quick Pay payments are non-refundable once initiated.

4. PRIVACY POLICY AND DATA HANDLING

PINCH is committed to protecting the privacy of our users. We collect personal data to ensure smooth platform operations and to facilitate payments and job assignments.

Types of Data Collected:

  • Basic Account Information: Name, email, phone number.

​

  • Business Information: Company name, business address, tax ID.

​

  • Payment Information: Bank account details, billing information.

​

  • Platform Usage Data: Job interactions, proposals, and job history.

​

  • Background Check Data: If required, identification and background check documents.

How We Use Your Data:

​

  • Service Provision: To manage job opportunities, payments, and customer support.

​

  • Payment Processing: Using third-party services like Stripe and QuickBooks.

​

  • Marketing: Sending updates and promotions about PINCH’s services.

​

  • Compliance: Ensuring compliance with legal and vendor requirements.

Third-Party Services: PINCH partners with third-party providers like Stripe (for payments) and QuickBooks (for bank verification). These providers comply with industry-standard privacy and security measures. PINCH does not sell or share personal data for advertising purposes.

5. NEWSLETTER

By registering with PINCH, you agree to receive our weekly newsletter, which includes industry updates, business growth strategies, job opportunities, and important platform updates. You may opt out at any time by clicking the 'unsubscribe' link in any email or adjusting your communication preferences in your account settings.

6. SMS PROGRAM

PINCH uses SMS messaging to communicate with Cleaners for job alerts, reminders, and updates. By opting in, Cleaners agree to receive messages related to job availability, transactional reminders, and marketing offers.

Types of Messages:

​

  • Job alerts and new opportunities.

​

  • Reminders for upcoming jobs and bi-directional communication with the PINCH Operations staff.

​

  • Marketing promotions and membership updates.

Message Frequency:

​

  • Cleaners may receive multiple messages per week depending on platform activity.

​

  • Standard message and data rates may apply.

Opt-Out and Help:

​

  • Cleaners can opt-out by replying "STOP" to any message.

​

  • For help, text "HELP" to PINCH’s dedicated number.

Compliance: PINCH’s SMS program complies with the TCPA and CTIA standards.

SMS Disclaimer: "You’re receiving job alerts & updates from PINCH. Message & data rates may apply. Reply STOP to unsubscribe or HELP for support."

7. LEGAL DISCLAIMERS AND LIMITATIONS OF LIABILITY

PINCH is a third-party platform connecting Cleaners with job opportunities. We are not responsible for the actions, performance, or disputes between Cleaners and property managers.

General Limitations of Liability:

​

  • No Guarantee of Job Availability: While PINCH provides access to job opportunities, we do not guarantee the availability, frequency, or profitability of jobs.

​

  • Service Interruptions: PINCH is not liable for temporary outages or technical malfunctions that affect access to the platform or services.

​

  • Third-Party Disputes: Any disputes arising from payment processing, insurance claims, or vendor-related issues are the responsibility of the third-party provider.

Data Loss and Security: PINCH employs encryption and security measures to protect personal data. However, PINCH is not responsible for data loss or security breaches caused by third-party systems.

Indemnification: By using PINCH, Cleaners agree to indemnify and hold harmless PINCH from any claims or legal disputes arising from their use of the platform.

8. GOVERNING AND JURISDICTION

This Agreement is governed by and construed in accordance with the internal laws of the State of South Carolina, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of or related to this Agreement or the PINCH Platform shall be instituted exclusively in the federal courts of the United States or the courts of the State of South Carolina, located in Charleston County, South Carolina. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

I HEREBY ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THE FOREGOING TERMS OF USE AND PRIVACY POLICY, AND AGREE THAT MY USE OF THE PINCH PLATFORM IS AN ACKNOWLEDGMENT OF MY AGREEMENT TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT.
